{"id":334,"date":"2025-05-06T15:58:24","date_gmt":"2025-05-06T13:58:24","guid":{"rendered":"https:\/\/mediaforum.hu\/?p=334"},"modified":"2025-05-06T16:04:15","modified_gmt":"2025-05-06T14:04:15","slug":"alkotmanymodositas-a-magyar-allampolgarsag-felfuggeszteserol","status":"publish","type":"post","link":"https:\/\/mediaforum.hu\/en\/2025\/05\/06\/alkotmanymodositas-a-magyar-allampolgarsag-felfuggeszteserol\/","title":{"rendered":"Constitutional Amendment Enables Suspension of Citizenship"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Fidesz-KDNP governing parties <\/span><span>have adopted a <a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2025\/03\/Bill_11152_EN_unofficial_translation.pdf\">constitutional amendment<\/a> that \u201ccreates the possibility that the Hungarian citizenship of Hungarian citizens who are also citizens of another state, not including citizens of states with the right of free movement and residence, is suspended in accordance with the provisions of a cardinal Act.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the new <a href=\"https:\/\/www.parlament.hu\/irom42\/11414\/11414.pdf\">legislation<\/a> to be adopted later, Hungarian citizenship may be suspended for individuals who are also citizens of non-European Economic Area (non-EEA) countries if they are found to be acting in the interests of a foreign power or organization in a manner deemed incompatible with Hungarian citizenship.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Legal and human rights experts have sharply <a href=\"https:\/\/telex.hu\/english\/2025\/04\/11\/in-our-view-the-suspension-of-citizenship-is-an-unprecedented-concept-in-international-law\">criticized<\/a> the legislation. According to international lawyers, \u201cthe suspension of citizenship is an unprecedented concept in international law, which may easily be misused. The expulsion of a state&#8217;s own citizens from their home country may amount to a form of exile and inhumane treatment, and may be contrary to the human rights conventions binding the state concerned\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Hungarian Helsinki Committee <a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2025\/03\/HHC_info_note_15th_Amendment_19032025.pdf\">denounced<\/a> the amendment as a \u201cvague and unprecedented provision (&#8230;) [which] creates legal uncertainty, raises serious human rights concerns, and effectively institutionalizes political intimidation\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legislation is part of the \u201c<a href=\"https:\/\/mediaforum.hu\/2025\/04\/11\/ujsagiro-poloskak-es-sajtoszabadsag\/\">Easter clean-up<\/a>,\u201d announced by Prime Minister Viktor Orb\u00e1n.
